Textile Industry Deafness Claims

Michael Kent QC and A John Williams represented Guy Warwick Limited and Christopher Purchas QC and Catherine Foster represented the Courtaulds Defendants before HH Judge Inglis (sitting as a Judge of the High Court). Judgment was handed down on 14 February in 7 test cases in which former textile workers claimed damages for noise induced hearing loss. The test claims (brought by former employees of Courtaulds; Coats, Pretty Polly & Guy Warwick Limited) raised important questions of breach of duty, diagnosis & causation where there was long term exposure to noise levels below 90 dB(A). Each of the test claims was dismissed.
