R v TDG (UK) Ltd [2008] EWCA Crim 1963

John Cooper appeared on behalf of the company in this case (a full report is provided in Chambers' new Health & Safety and Regulatory Law Update) in which the CoA allowed an appeal against a fine of £325,000 and gave guidance as to the way courts should approach sentencing in the field of Health and Safety work, given that there were no tariffs available to assist a court.

The fine was reduced to £275,000 and costs were awarded from central funds.
