Biffa Waste Services Ltd v Maschinenfabrik Ernst Hese GmbH [2008] BLR 155

James Medd was instructed by one of the Defendants in the Biffa Waste Services case, a recent decision of Ramsey J in the TCC.

The editors of the Building Law Reports, in which the case has just been reported, described the case as "very complex" but containing a useful summary of various prinicples, particularly in relation to liquidated damages clauses, the concurrent liability in contract and tort, vicarious liability and ultra-hazardous activity.
