Malcolm is a leader in the field of criminal regulatory law in Health and Safety and Environmental Law. He has substantial criminal trial experience and is ranked for both Health and Safety and Environmental Law in Chambers and Partners and the Legal 500.
His Health and Safety practice focuses on representing directors and corporations facing regulatory investigations, usually involving fatalities or serious life changing injuries, in the Criminal Courts or Coroners Court.
He is one of the foremost defence Counsel in waste and water prosecutions, his clients include water companies and other large public bodies.
He has appeared frequently in the Court of Appeal and Divisional Court including a number of cited guideline cases.
In 2012 he was appointed a Crown Court Recorder (part-time judge) on the Western Circuit. In 2015 he was 'ticketed' to hear appeals from the Magistrates Court and in 2016 to sit as a Crown Court judge in cases involving allegations of serious sexual assaults and child abuse cases.
